When you book a shipment through NixTracking, you represent and warrant that:
- You are authorized to ship the items and have provided accurate sender and recipient information.
- The shipment contents are legal, properly described, and packaged for transport.
- You will comply with all applicable laws and customs regulations for origin and destination countries.
We may refuse or cancel a shipment at our discretion if we suspect illegal contents, incorrect information, or a safety risk.
5. Tracking & Information Accuracy
We provide tracking information as a convenience. Tracking updates are provided by our systems and partners and may be delayed, incomplete, or temporarily unavailable. We do our best to provide accurate information but cannot guarantee real-time accuracy.
6. Pricing & Payment
Prices for shipments and services are displayed at booking or provided in quotes. You agree to pay all charges incurred for the Services, including shipping costs, taxes, duties, and fees. Payment methods and billing information are subject to validation and acceptance by us or our payment processor.
7. Cancellations & Refunds
Cancellation rules depend on the service type and stage of shipment. If you cancel before pick-up and the shipment has not entered the carrier network, we may provide a refund less any non-refundable fees. Refunds are processed according to our refund policy and payment processor rules.
8. Liability & Limitation of Liability
Important: To the fullest extent permitted by law:
- We and our affiliates, employees, agents, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
- Our total liability for direct damages arising out of or related to these Terms or our Services will not exceed the amount you paid to us for the specific shipment giving rise to the claim (or, if no payment was made, a reasonable sum determined by us), except where prohibited by law.
- We are not responsible for delays, losses, or damage caused by third-party carriers, customs authorities, extreme weather, acts of God, war, strikes, or other events beyond our reasonable control.
9. Insurance & Declared Value
Shipments may include an option to declare value or purchase insurance. Declaring a value may affect limits on liability and insurance coverage. If you choose additional coverage, it will be subject to the policy terms of the insurer. Standard service includes limited liability as defined by international and local carrier rules.
10. Prohibited Items
Shipments must not contain prohibited or restricted items. Examples include (but are not limited to): illegal drugs, flammable explosives, hazardous materials not properly declared, counterfeit goods, and items prohibited by local law or carrier rules. If we discover prohibited items, we may refuse, return, or destroy the shipment and notify the sender and authorities as required.
11. Intellectual Property
All content on the Site (text, logos, graphics, images, design, software) is owned or licensed by NixTracking and is protected by copyright, trademark, and other laws. You may not copy, reproduce, republish, or create derivative works without our express written permission.
12. User Content
If you provide content to the Site (feedback, messages, or other materials), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute that content for the purpose of providing and improving the Services.
